Trading Terms

1. About these terms
These terms apply to plumbing, heating, renewable energy and electrical work carried out by Culbertson Renewables Ltd, registered in Scotland under company number SC764046, registered office 13a Bridge Street, Edinburgh, Scotland, EH15 1DB ("we", "us", "our"). Together with our written quotation, they form the contract between us and you, the customer. If anything in these terms is unclear, please ask us before accepting a quotation.
2. Quotations
- Quotations are free and provided in writing following a survey or site visit where needed.
- A quotation is valid for 30 days from the date it is issued, unless it states otherwise.
- A quotation covers only the work and materials described in it. Additional work is agreed and priced separately before it is carried out.
3. Acceptance and deposits
A contract is formed when you accept our quotation in writing (including by email) or pay any deposit stated in it. Where a deposit is required for renewable energy installations, it is protected in line with our accreditation requirements, including insurance-backed deposit and guarantee protection.
4. Prices and payment
- Prices are as stated in the quotation and include VAT where applicable.
- Unless agreed otherwise in writing, payment is due on completion of the work, against our invoice.
- For larger projects we may agree staged payments in the quotation.
- We may charge interest on overdue amounts as permitted by law.
5. Scheduling, access and site conditions
- Installation dates are given in good faith. We will tell you promptly if a date has to change, for example because of material availability or weather.
- You agree to give us safe, reasonable access to the property, and to water, drainage and electricity, while we carry out the work.
- If unforeseen conditions at the property (for example concealed pipework, asbestos, or defects in existing systems) affect the work, we will stop, explain the position and agree any changes with you before continuing.
6. Variations
Either of us can propose a change to the agreed work. Changes, and any effect on the price or timescale, are confirmed in writing before the changed work is carried out.
7. Your right to cancel
If you are a consumer and the contract was made away from our premises (for example at your home) or at a distance (for example by phone or email), you have the right to cancel within 14 days of entering the contract without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- To cancel, tell us in writing within the 14-day period using the contact details below.
- If you ask us in writing to start work within the 14-day period and then cancel, you must pay for the work done and materials used up to cancellation.
- Bespoke or specially ordered materials may not be returnable once ordered; we will tell you before ordering them.
8. Guarantees and standards
- All work is carried out to the standards of our accreditations, including Gas Safe registration (No. 945297), NICEIC and MCS certification.
- Our workmanship is guaranteed for 12 months from completion, in addition to (not instead of) your statutory rights.
- Manufacturer warranties apply to boilers, heat pumps, panels, batteries and other equipment, and we will register these for you where applicable.
- Where required by our renewable accreditations, an insurance-backed guarantee is provided for your installation.
9. Title and risk
Materials remain our property until paid for in full, and are at your risk once delivered to your property.
10. Our liability
We hold public liability insurance. We are responsible for foreseeable loss or damage caused by our negligence or our failure to carry out the work with reasonable care and skill. We are not responsible for loss that was not foreseeable, for pre-existing defects in your property or systems that we have not worked on, or for fair wear and tear. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights are not affected.
11. Complaints
If you are unhappy with any aspect of our work, contact us first at office@culbertsonrenewables.co.uk or on 0131 669 4732 and we will try to put things right quickly. For renewable energy installations, we follow the Renewable Energy Consumer Code (RECC), which includes access to independent dispute resolution if we cannot resolve a complaint between us.
12. General
These terms are governed by the law of Scotland and the Scottish courts have jurisdiction. If any part of these terms is found to be unenforceable, the rest continues to apply.
